Terms of service

These terms govern your access to and use of the Xplorout website, mobile application, discovery tools, social features and provider tools. By creating an account or using the service, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.
1. Service provider
Xplorout is provided by Sid A. Abdala Balal. Public disclosure wording: "XplorOut is operated by Sid Balal.", 4 Stirling Lane, Apt 506, GX11 1AA, Gibraltar. Contact: hello@xplorout.com.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering a contract to create an account or use social meeting features. Information supplied during registration must be accurate and kept current. You are responsible for protecting your credentials and for activity under your account. Notify us promptly if you suspect unauthorised access.
One person or business may not create deceptive, impersonating or abusive accounts. You may use core public discovery features without signing in where the app permits it.
3. What Xplorout provides
Xplorout helps users discover and organise third-party events, attractions, activities and experiences using location, time, interests and other selected criteria. Results are recommendations, not guarantees. Unless a listing expressly states otherwise, Xplorout is not the organiser, venue, ticket seller or payment processor and does not itself sell the underlying ticket or activity.
4. Listings, availability and accuracy
Listings may come from operators, public sources, commercial data partners or registered businesses. Prices, schedules, availability, accessibility, age restrictions, locations, cancellation rules and other details can change. Check the final information and provider terms before paying or travelling. A listing does not amount to endorsement, safety certification or a guarantee that an activity is suitable for you.
Please report inaccurate or outdated information using the in-app correction tool or Support. We may correct, merge, suspend or remove listings.
5. Third-party bookings and affiliate links
When you follow a booking link, you leave Xplorout and contract directly with the named operator or booking provider. Their terms, privacy policy, payment, cancellation, refund and customer-service rules apply. Questions about an order, ticket, cancellation or refund should normally be directed to that provider.
Xplorout may receive a commission when you follow a labelled partner link and complete an eligible transaction. This normally does not increase the price you pay. Commercial relationships may affect which inventory is available to display, but paid arrangements do not secretly determine organic recommendation ranking.
6. Your plans, travel and safety
Distances, routes, travel times, weather and arrival estimates are informational estimates and may be delayed, incomplete or inaccurate. Conditions can change quickly. Confirm transport, opening times, weather, accessibility and local safety information yourself. Do not use Xplorout as an emergency, navigation-safety or professional advice service.
7. Social features and meeting other users
“Wanna Come?” invitations and chats help adults connect around an activity. Xplorout does not verify every user or supervise meetings and cannot guarantee another user's identity, intentions or conduct. Use reasonable precautions: meet in public, keep early communication in the app, tell someone your plans, arrange your own transport, protect financial and identity information, and leave or contact emergency services if you feel unsafe.
You can report content and block users in the app. Reporting an invitation or message sends relevant information for moderation; blocking limits that person's visibility and contact for your account. In an immediate emergency, contact local emergency services, including 112 where applicable.
8. Acceptable use
You must not use Xplorout to:
- break the law, facilitate dangerous conduct or infringe another person's rights;
- harass, threaten, exploit, stalk, discriminate against, impersonate or deceive anyone;
- publish sexual exploitation material, non-consensual intimate content, hate content, credible threats or instructions for serious wrongdoing;
- send spam, scams, unauthorised advertising or misleading commercial invitations;
- scrape, copy, reverse engineer, overload, probe or interfere with the service or its security except where applicable law expressly permits;
- upload malware, misuse accounts, evade blocks or suspensions, or manipulate rankings and reports;
- post personal data about another person without a lawful basis or permission; or
- submit content or listings you do not have the right or authority to provide.
9. User content and licence
You retain ownership of content you submit. You grant Xplorout a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical formatting, translate, display and distribute that content only as reasonably necessary to operate, secure, improve and promote the relevant Xplorout feature. The licence ends when the content is deleted, except for cached or backup copies, content shared with others that they retain, and material lawfully preserved for safety or legal reasons.
You represent that your content is accurate where it presents facts, does not violate law or third-party rights, and that you have the permissions required to submit it. Feedback and suggestions may be used without obligation to you.
10. Provider and business accounts
A provider may register a venue or business for approval and publish only on behalf of an organisation it is authorised to represent. Registration does not transfer ownership of a business page or create an agency relationship with Xplorout. Submitted business details, locations, images, service descriptions, schedules, prices and booking links must be lawful, accurate, current and supported by the necessary rights and licences.
Approval may be refused, suspended or withdrawn if authority cannot be verified, information is misleading, complaints raise safety concerns, or these terms are breached. Providers remain responsible for their services, customers, insurance, permits, taxes, consumer obligations and fulfilment.
11. Moderation and enforcement
We may review reports and take proportionate action, including reducing visibility, removing content, cancelling invitations, restricting features, preserving evidence or suspending or terminating accounts. We consider context, severity, repetition, user safety and legal obligations. Automated signals may help prioritise reviews, but material moderation decisions may be reviewed by a person where appropriate.
Where reasonably possible and legally permitted, we will explain a significant restriction. You may request review by contacting hello@xplorout.com with the account email and relevant details. We may act without advance notice where urgent action is needed for safety, security, fraud prevention or legal compliance.
12. Intellectual property
Xplorout's software, branding, interface and original content are protected by intellectual-property law. These terms give you a limited, personal, revocable, non-transferable right to use the service as intended; they do not transfer ownership. Third-party names, images and listing content remain the property of their respective owners.
To report alleged infringement, email hello@xplorout.com with your contact details, the protected work, the material at issue, its location and the basis for your claim.
13. Availability and changes
We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Features, integrations, coverage and listings may change or be withdrawn. We may update these terms when the service, business or law changes. Material changes will be notified where required, and the updated date will be shown above.
14. Account termination and deletion
You may stop using Xplorout at any time and delete your account in the app or through the process at xplorout.com/delete-account. We may restrict or terminate access for material or repeated breach, unlawful activity, fraud, serious safety risk, prolonged inactivity where permitted, or threats to the service. Provisions that by their nature should survive termination—including ownership, lawful retention, liability and dispute provisions—continue to apply.
15. Liability and consumer rights
Nothing in these terms excludes or limits liability, remedies or statutory consumer rights where exclusion is prohibited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable. Xplorout remains responsible for its own obligations to the extent required by law.
To the extent permitted by law, Xplorout is not responsible for independent third-party operators, venues, booking providers or users; their acts, omissions, safety, quality, cancellations, pricing or performance; or arrangements users independently make with one another. We are not liable for losses that were not reasonably foreseeable when you accepted these terms or for business losses incurred by a consumer.
16. Law, complaints and contact
These terms are governed by Spanish law, without depriving consumers of mandatory protections available under the law of their country of residence. Courts with jurisdiction under applicable consumer law may hear disputes. Please first contact hello@xplorout.com so we can try to resolve a complaint.
If one provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver. You may not transfer your account or these terms without our consent; we may transfer the service subject to applicable law and continued protection of your rights.
